Welcome to Andy H Photography. Please read these Sales Terms and Conditions carefully before placing an order. By purchasing any fine art print or product from this website, you unconditionally agree to be bound by the terms outlined below.
1. Our Business Setup & Printing Partnership
Andy H Photography operates as an independent art retail platform. All photographic imagery showcased on this website is the exclusive intellectual property of the artist.
To deliver gallery-grade, museum-standard quality prints to collectors worldwide, we operate using a professional, white-label print-on-demand fulfillment model.
Fulfillment: When you purchase a print, the order is instantly transmitted to our production partner, creativehub (operated by theprintspace based in London, UK). They handle the professional printing, archival packaging, and secure global courier routing.
Contract of Sale: Your legal contract of sale is strictly with Andy H Photography. No legal relationship exists between you and creativehub or their third-party couriers. All customer service inquiries, status updates, or claims must be sent directly to us.
2. Product Descriptions & Made-to-Order Status
2.1 Color and Screen Variations
We strive for extreme accuracy in our digital mockups. However, due to personal device monitor calibrations, brightness levels, and color profiles, subtle variations in contrast, saturation, or hue may occur between your screen render and the physical fine art print. These minor variations are normal and do not constitute a product defect.
2.2 Bespoke Custom Classification
Every fine art print sold on this website is exclusively made-to-order. Production does not begin until your payment clears. Because each item is custom-printed to your chosen size, image choice, and paper finish, our products are classified as custom-made.
Legal Notice under UK Law: Because all prints are custom manufactured to your specifications on demand, they fall directly within the exemption for "made-to-order" or "custom-made" goods under Regulation 28(1)(b) of the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
3. Pricing, Payments & Order Acceptance
Currency: All prices on this website are set in £ (GBP). Shipping costs are calculated dynamically and displayed transparently at the checkout before you authorize payment and where possible converted to local currency at the prevailing rate
Pricing Errors: We reserve the right to correct any typographical or system errors in pricing. If an error is caught after your order is submitted, we will contact you immediately to give you the option of reconfirming at the correct price or receiving a full refund.
Acceptance: Your order represents an offer to buy. A binding contract is formed only when we issue your formal "Order Dispatch Confirmation" email.
4. Shipping, Deliveries & Customs Duties
Estimates: Delivery timelines provided at checkout are good-faith estimates supplied by creativehub and their logistics networks. They are not concrete legal guarantees.
Delays: We cannot be held legally or financially responsible for delivery delays caused by courier logistics, border customs backlogs, adverse weather events, or regional postal strikes.
International Customs & Taxes: For all shippedorders, you are legally recognized as the "Importer of Record" and may be subject to import taxes.
Important Cross-Border Policy: You are solely responsible for paying any local customs tariffs, import taxes, clearance fees, or local Value Added Tax (VAT) applied by your country's border authorities. If you refuse a package due to unexpected customs fees, any return shipping penalties or product losses charged by our courier will be deducted from any potential refund or resolution.
5. Cancellation and Returns Policy (Buyer's Remorse)
No Right to Cancel for Change of Mind: As detailed in Section 2.2, all fine art prints are custom-made items. Therefore, the standard statutory 14-day cooling-off period under the UK Consumer Contracts Regulations does not apply to purchases on this site.
Final Sales: We do not accept returns, exchanges, or cancellations if you change your mind, find that the print color does not perfectly match your room, or realize you ordered the incorrect size. All finalized checkout sales are definitive. Please double-check your wall dimensions and framing options before buying.
6. Damaged, Defective, or Incorrect Deliveries
In the rare event that your print arrives damaged by the courier or suffers from a manufacturing defect, we will arrange a zero-cost replacement print through creativehub, subject to the strict validation process below.
6.1 The 7-Day Notification Window
You must inspect your package immediately upon delivery. Any claim for transit damage or printing defects must be emailed to me at info@andyh.photography within five (5) calendar days of the courier's confirmed delivery timestamp.
6.2 Mandatory Evidence Requirements
To file a successful replacement claim with our print lab, you must attach the following photographic proof to your email:
Clear photos of the external packaging, highlighting all dents, tears, creases, or puncture marks, with the shipping label fully visible.
Clear, high-resolution photos of the physical fine art print, capturing the exact damage, crease, scratch, or printing blemish.
Failure to provide this photographic evidence within the 7-day window invalidates our print lab's insurance agreement. We will be unable to issue a free replacement if this window is missed.
6.3 Do Not Return the Item
Please do not ship damaged or defective items back to us or back to creativehub unless explicitly requested in writing. In almost all cases, our print lab requires photographic proof of destruction rather than physical return shipping.
7. Intellectual Property & Copyright
Purchasing a physical fine art print grants you the right to display the physical item for personal enjoyment or commercial interior styling. It does not transfer copyright, reproduction rights, or digital ownership to you.
You are strictly prohibited from digitally scanning, copying, duplicating, or creating derivative products from the physical print for commercial resale or digital distribution without explicit, written legal consent from Andy H Photography.
8. Limitation of Liability
To the maximum extent permitted by English law, Andy H Photography’s entire financial liability to you regarding any individual purchase is strictly capped at the total amount you paid for that specific order (including shipping).
We shall not be liable for any indirect, incidental, or consequential damages—including but not limited to loss of business, custom picture framing costs, art installation fees, or storage fees—arising out of a delayed or damaged delivery.
9. Governing Law & Dispute Resolution
These Terms, and any disputes arising out of them, shall be governed exclusively by and construed in accordance with the laws of England and Wales. Any unresolved legal conflicts shall be subject to the exclusive jurisdiction of the courts of England and Wales.
